Terms of Service

These terms are an agreement between you (and the company you sign up for) and Danny Weber, doing business as Solar Care HQ (“we”, “us”). They cover your use of Solar Care HQ, the website and the lead data in it (the “Service”). By creating an account or using the Service you accept them. If you do not agree, do not use the Service.

1. What the Service is

Solar Care HQ is a business tool for companies that clean or service solar panels. It estimates which buildings in an area you choose already have solar panels, using public records (such as building permits), aerial imagery, open map data and automated image analysis, and gives you a CRM to work those leads: call lists, routes, jobs and invoices. The Service covers California county by county (today: Stanislaus and San Joaquin counties); we add counties as customers ask for them, and the first scan in a new county takes longer while we load its records.

2. Who can use it

The Service is for businesses. You must be at least 18 and able to agree to these terms for your company. You are responsible for everyone you invite to your company account, for keeping passwords safe, and for all activity under your account. Tell us right away at danny@attractandclose.com if you think your account has been misused.

3. Lead data is an estimate

  • Leads are produced automatically and can be wrong: a building may not have solar, the panels may belong to a neighbor, an address may be off, and records may be out of date. We do not guarantee any number of leads, their accuracy, or that any lead will become a customer.
  • Leads are not exclusive. An area is scanned once and the results are shared: other customers who unlock an overlapping area see the same buildings.
  • When you mark a lead “Confirm solar”, “Not solar” or “Wrong address”, you let us use that answer to improve the Service for everyone. We do not share your notes, contacts, jobs or invoices with other customers.

4. Prices and payment

  • Before you pay for an area, the app shows its price. That price is a one-time charge for that area. Some plans also have a monthly account fee, shown before you pay. Payments are processed by Stripe.
  • The monthly fee renews each month until you cancel. You can cancel at any time under Settings → Billing & payments; it stops at the end of the period you already paid for. We do not give partial-month refunds.
  • If a scan you paid for fails or does not finish, we will run it again at no charge, or refund what you paid for that area if we cannot complete it. Email danny@attractandclose.com within 30 days of the charge with any billing problem. Because area prices pay for scanning work that has already been done, they are otherwise non-refundable.
  • We may change prices for future purchases. A quote you have already been shown stays valid until it expires.

5. How you may use the leads

You may use the leads and the Service only to market and provide your own services. You agree to:

  • Follow every law that applies to contacting people, including the Telephone Consumer Protection Act and the National and California Do Not Call rules (no autodialed or prerecorded calls or texts without consent), CAN-SPAM for email, and local rules for door-to-door sales (permits, hours, “No Soliciting” signs).
  • Stop contacting anyone who asks you to, and honor property owners' requests to be left alone.
  • Not sell, rent, publish or give the lead data to anyone outside your company, and not use it to build a competing product or database.
  • Not use the Service to discriminate, harass, stalk, or make decisions about credit, insurance, housing or employment.
  • Not scrape, copy in bulk, overload, reverse engineer or try to get around the Service's limits or security, and not share your login outside your company.

6. Your data

What you put into the CRM (customers, notes, calls, jobs, invoices) belongs to you. You give us permission to store and process it only to run the Service for you. You are responsible for having the right to enter it, including any personal information about your own customers. You can ask us for a copy of it or to delete it. Our Privacy Policy explains how we handle personal information.

7. Third-party data and services

The Service includes data from third parties. Their licenses and notices apply:

  • Map and building data © OpenStreetMap contributors (Open Database License), Overture Maps Foundation, Microsoft and Esri Community Maps (CC BY 4.0).
  • Imagery: USDA NAIP (U.S. Department of Agriculture) and USGS The National Map.
  • Parcel and permit records from California counties and cities, provided by them “as is”. You agree not to hold those agencies responsible for how you use them.
  • Payments use Stripe, and your use of Stripe is also subject to Stripe's terms.

8. Our rights

We own the Service, its software and the compiled lead database. While your account is in good standing, we give you a limited, non-exclusive, non-transferable right to use them under these terms. We may change or improve the Service. We may suspend or close an account that breaks these terms, puts others at risk, or does not pay, and will tell you why when we can.

9. Ending the agreement

You can stop using the Service and cancel at any time. When an account is closed, your right to use the leads ends, and we delete your company's data within 90 days unless the law requires us to keep it (for example, payment records).

10. Disclaimers

THE SERVICE AND ALL LEAD DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Your responsibility to us

You will defend and hold us, and the public agencies whose records we use, harmless from claims, fines and costs that arise from how you or your team contact people, use the leads, or break these terms or the law.

13. Law and disputes

California law governs these terms. Any dispute will be handled in the state or federal courts located in Stanislaus County, California, and both sides agree to those courts. Before filing a claim, please email us so we can try to resolve it.

14. Changes

We may update these terms. If a change is significant, we will tell you by email or in the app at least 14 days before it takes effect. If you keep using the Service after that, the new terms apply.
